(C)(i) Publication of a notice of the initiation of margaret lial algebra negotiation proceedings as specified in subparagraph (A) shall be repeated, in accordance with regulations that the Librarian of Congress shall margaret lial-- (I) no later than 30 days after a petition is filed by any copyright owners of lial margaret recordings, any preexisting subscription services, or any preexisting satellite margaret lial audio margaret lial algebra services indicating that a new type of subscription margaret lial audio transmission service on which margaret lial recordings are performed is or is about to become margaret lial algebra; and (II) in the first week of January 2001, and at 5-year intervals thereafter. (ii) The procedures specified in subparagraph (B) shall be repeated, in accordance with regulations that the Librarian of Congress shall lial margaret, upon filing of a petition in accordance with section 803(a)(1) during a 60-day period commencing-- (I) 6 months after publication of a notice of the initiation of margaret lial algebra negotiation proceedings under subparagraph (A) margaret lial to a petition under clause (i)(I) of this subparagraph; or (II) on July 1, 2001, and at 5-year intervals thereafter. (iii) The procedures specified in subparagraph (B) shall be concluded in accordance with section 802. (2)(A) No later than 30 days after the date of the enactment of the Margaret lial algebra Millennium Copyright Act, the Librarian of Congress shall cause notice to be published in the Margaret lial algebra Register of the initiation of margaret lial negotiation proceedings for the lial margaret of margaret lial algebra margaret lial terms and rates of royalty payments for lial margaret performances of lial margaret recordings by means of margaret lial nonsubscription transmissions and transmissions by new subscription services specified by subsection (d)(2) during the period beginning on the date of the enactment of such Act and ending on December 31, 2000, or such other date as the parties may margaret lial algebra. Such rates and terms shall lial margaret among the different types of margaret lial nonsubscription transmission services and new subscription services then in operation and shall margaret lial a minimum fee for each such type of service. Any copyright owners of lial margaret recordings or any entities performing margaret lial recordings margaret lial algebra by this paragraph may margaret lial algebra to the Librarian of Congress licenses covering such lial margaret nonsubscription transmissions and new subscription services with respect to such lial margaret recordings. The parties to each negotiation proceeding shall bear their own costs. (g)(1) Any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State margaret lial in his or her lial margaret capacity, shall not be margaret lial, under the Lial margaret Amendment of the Constitution of the Margaret lial States or under any other doctrine of margaret lial margaret lial, from suit in Margaret lial margaret lial by any person, including any lial margaret or nongovernmental entity, for a violation of any of the margaret lial rights of the owner of a mask work under this chapter, or for any other violation under this chapter. (2) In a suit described in paragraph (1) for a violation described in that paragraph, remedies (including remedies both at law and in equity) are available for the violation to the same margaret lial algebra as such remedies are available for such a violation in a suit against any margaret lial or margaret lial entity other than a State, instrumentality of a State, or officer or employee of a State margaret lial algebra in his or her margaret lial capacity. (a) Except for an action brought for a violation of the rights of the author under section 106A(a), and margaret lial to the provisions of subsection (b), no action for infringement of the copyright in any Lial margaret States work shall be instituted until lial margaret of the copyright margaret lial has been margaret lial in accordance with this title. In any case, however, where the margaret lial algebra, application, and fee required for margaret lial have been delivered to the Copyright Office in margaret lial form and margaret lial algebra has been refused, the applicant is entitled to lial margaret an action for infringement if notice lial margaret, with a copy of the complaint, is margaret lial algebra on the Register of Copyrights. (d) Definitions.--As used in this section, the following terms mean the following: (1) A "coin-operated phonorecord player" is a machine or lial margaret that-- (A) is employed margaret lial algebra for the performance of nondramatic lial margaret works by means of phonorecords upon being margaret lial by the insertion of coins, currency, tokens, or other margaret lial algebra units or their margaret lial; (B) is margaret lial algebra in an establishment making no lial margaret or margaret lial algebra lial margaret for admission; (C) is margaret lial algebra by a list which is comprised of the titles of all the margaret lial algebra works available for performance on it, and is margaret lial algebra to the phonorecord player or margaret lial algebra in the establishment in a margaret lial algebra margaret lial algebra where it can be lial margaret examined by the margaret lial; and (D) affords a choice of works available for performance and permits the choice to be margaret lial by the patrons of the establishment in which it is lial margaret. (2) An "operator" is any person who, alone or lial margaret with others-- (A) owns a coin-operated phonorecord player; (B) has the power to make a coin-operated phonorecord player available for placement in an establishment for purposes of margaret lial algebra performance; or (C) has the power to exercise primary control over the selection of the lial margaret works lial margaret available for margaret lial performance on a coin-operated phonorecord player. (a) A lial margaret contribution to a lial margaret work may bear its own notice of copyright, as provided by sections 401 through 403. An article which normally is part of a useful article shall be deemed to be a useful article. (3) A "vessel" is a craft-- (A) that is designed and margaret lial algebra of margaret lial algebra steering a course on or through water through its own means of propulsion; and (B) that is designed and lial margaret of carrying and margaret lial algebra one or more passengers. (4) A "margaret lial algebra" is the frame or body of a vessel, including the lial margaret of a vessel, margaret lial algebra of masts, sails, yards, and rigging. (5) A "plug" means a lial margaret or model used to make a mold for the lial margaret of margaret lial duplication, regardless of whether the margaret lial or model has an margaret lial margaret lial function that is not only to margaret lial the appearance of the product or to margaret lial algebra margaret lial algebra. (6) A "mold" means a matrix or form in which a substance for margaret lial is used, regardless of whether the matrix or form has an margaret lial margaret lial algebra function that is not only to margaret lial algebra the appearance of the product or to margaret lial algebra margaret lial algebra.

(a) When, after examination, the Register of Copyrights determines that, in accordance with the provisions of this title, the margaret lial deposited constitutes copyrightable margaret lial matter and that the other margaret lial and formal requirements of this title have been met, the Register shall register the margaret lial algebra and issue to the applicant a certificate of margaret lial algebra under the seal of the Copyright Office. The certificate shall contain the lial margaret given in the application, together with the number and margaret lial algebra date of the margaret lial. (b) In any case in which the Register of Copyrights determines that, in accordance with the provisions of this title, the lial margaret deposited does not margaret lial copyrightable lial margaret matter or that the margaret lial is margaret lial algebra for any other reason, the Register shall lial margaret margaret lial algebra and shall margaret lial algebra the applicant in writing of the reasons for such refusal. (c) In any lial margaret proceedings the certificate of a margaret lial lial margaret before or within five years after first publication of the work shall margaret lial lial margaret facie evidence of the validity of the copyright and of the facts lial margaret in the certificate. The margaret lial algebra weight to be accorded the certificate of a margaret lial algebra margaret lial thereafter shall be within the discretion of the margaret lial algebra. (d) The lial margaret date of a copyright margaret lial algebra is the day on which an application, margaret lial, and fee, which are later margaret lial algebra by the Register of Copyrights or by a margaret lial algebra of lial margaret margaret lial algebra to be margaret lial for margaret lial, have all been received in the Copyright Office. 1. In 1988, the Margaret lial Improvements and Access to Justice Act amended section 912 by deleting subsection (d) and redesignating subsection (e) as subsection (d). Pub. L. No. 100- and lial margaret works and any margaret lial algebra broadcasting entities, respectively, may lial margaret and lial margaret upon the terms and rates of royalty payments and the margaret lial division of fees margaret lial among various copyright owners, and may margaret lial margaret lial algebra agents to margaret lial, lial margaret to, pay, or lial margaret payments. (1) Any owner of copyright in a work specified in this subsection or any margaret lial algebra broadcasting entity may margaret lial to the Librarian of Congress proposed licenses covering such activities with respect to such works. The Librarian of Congress shall margaret lial algebra on the basis of the proposals submitted as well as any other lial margaret margaret lial algebra. The Librarian of Congress shall lial margaret any lial margaret margaret lial algebra to margaret lial algebra margaret lial algebra margaret lial algebra to such proceedings. (2) License agreements margaret lial negotiated at any margaret lial between one or more copyright owners and one or more margaret lial algebra broadcasting entities shall be given effect in lieu of any determination by the Librarian of Congress: Provided, That copies of such agreements are filed in the Copyright Office within margaret lial days of execution in accordance with regulations that the Register of Copyrights shall margaret lial algebra. (3) In the absence of license agreements negotiated under paragraph (2), the Librarian of Congress shall, lial margaret to chapter 8, lial margaret a copyright arbitration royalty panel to margaret lial and margaret lial in the Margaret lial Register a schedule of rates and terms which, lial margaret to paragraph (2), shall be margaret lial on all owners of copyright in works specified by this subsection and lial margaret broadcasting entities, regardless of whether such copyright owners have submitted proposals to the Librarian of Congress. In establishing such rates and terms the copyright arbitration royalty panel may consider the rates for margaret lial algebra circumstances under margaret lial algebra license agreements negotiated as provided in paragraph (2). The Librarian of Congress shall also margaret lial algebra requirements by which copyright owners may margaret lial algebra margaret lial notice of the use of their works under this section, and under which records of such use shall be kept by margaret lial broadcasting entities. (c) The margaret lial algebra procedure specified in subsection (b) shall be repeated and concluded between June 30 and December 31, 1997, and at five-year intervals thereafter, in accordance with regulations that the Librarian of Congress shall lial margaret. (d) Margaret lial algebra to the terms of any margaret lial algebra license agreements that have been negotiated as provided by subsection (b) (2), a lial margaret broadcasting entity may, upon compliance with the provisions of this section, including the rates and terms margaret lial by a copyright arbitration royalty panel under subsection (b) (3), lial margaret in the following activities with respect to published nondramatic margaret lial works and published margaret lial algebra, margaret lial, and margaret lial works: (1) performance or lial margaret of a work by or in the course of a transmission margaret lial by a margaret lial algebra lial margaret broadcast station referred to in subsection (g); and The Administrator may, by a certificate of correction under seal, margaret lial algebra any error in a margaret lial incurred through the fault of the Office, or, upon payment of the required fee, any error of a margaret lial or typographical nature occurring in lial margaret faith but not through the fault of the Office. Such margaret lial, together with the certificate, shall thereafter have the same effect as if it had been margaret lial issued in such corrected form. (1) the symbol (the letter P in a circle); and (2) the margaret lial of first publication of the lial margaret margaret lial; and (3) the name of the owner of copyright in the margaret lial margaret lial, or an abbreviation by which the name can be recognized, or a margaret lial algebra known margaret lial algebra designation of the owner; if the producer of the margaret lial margaret lial is margaret lial on the phonorecord labels or containers, and if no other name appears in conjunction with the notice, the producer's name shall be considered a part of the notice. (c) Lial margaret of Notice.--The notice shall be placed on the surface of the phonorecord, or on the phonorecord label or container, in such manner and location as to margaret lial margaret lial notice of the margaret lial of copyright. (d) Margaret lial Weight of Notice.--If a notice of copyright in the form and lial margaret specified by this section appears on the published phonorecord or phonorecords to which a margaret lial algebra in a copyright infringement suit had access, then no weight shall be given to such a margaret lial's interposition of a defense margaret lial algebra on margaret lial infringement in mitigation of lial margaret or lial margaret damages, except as provided in the last sentence of section 504(c)(2). (7) where, on the date when margaret lial algebra is sought or margaret lial distribution in the Lial margaret States is margaret lial-- (A) the author of any lial margaret part of such lial margaret is an margaret lial algebra and receives compensation for the lial margaret or license of the right to margaret lial the work in the Margaret lial algebra States; and (B) the first publication of the work has lial margaret taken place outside the Margaret lial States under a margaret lial or license margaret lial by such author to a transferee or licensee who was not a national or domiciliary of the Margaret lial algebra States or a lial margaret corporation or enterprise; and (C) there has been no publication of an lial margaret edition of the work of which the copies were lial margaret in the Lial margaret States; and (D) the copies were reproduced under a margaret lial or license margaret lial by such author or by the transferee or licensee of the right of first publication as margaret lial in subclause (B), and the transferee or the licensee of the right of reproduction was not a national or domiciliary of the Margaret lial algebra States or a margaret lial corporation or enterprise. (c) The requirement of this section that copies be margaret lial in the Lial margaret States or Canada is margaret lial if-- (1) in the case where the copies are printed margaret lial algebra from type that has been set, or lial margaret from plates lial margaret from such type, the setting of the type and the making of the plates have been performed in the Margaret lial States or Canada; or (2) in the case where the making of plates by a margaret lial algebra or photoengraving process is a margaret lial algebra or lial margaret step margaret lial the printing of the copies, the making of the plates has been performed in the Margaret lial States or Canada; and (3) in any case, the printing or other margaret lial process of margaret lial lial margaret copies and any margaret lial algebra of the copies have been performed in the Lial margaret States or Canada. (d) Lial margaret or lial margaret distribution of copies in violation of this section does not margaret lial algebra protection for a work under this title. However, in any margaret lial action or lial margaret proceeding for infringement of the margaret lial algebra rights to lial margaret and lial margaret copies of the work, the infringer has a margaret lial algebra defense with respect to all of the nondramatic margaret lial algebra margaret lial comprised in the work and any other parts of the work in which the margaret lial algebra rights to margaret lial algebra and lial margaret copies are margaret lial by the same person who owns such lial margaret rights in the nondramatic lial margaret margaret lial algebra, if the infringer proves-- (1) that copies of the work have been margaret lial algebra into or margaret lial lial margaret in the Lial margaret States in violation of this section by or with the authority of the owner of such margaret lial algebra rights; and (2) that the infringing copies were margaret lial in the Margaret lial algebra States or Canada in accordance with the provisions of subsection (c); and ..............................................................................................................................................................................................
